Adaptable Open Educational Resources Publishing Agreement

Creative Commons USA, the Rebus Community, and the Open Textbook Network (OTN) have worked together to create an Adaptable Open Educational Resources (OER) Publishing Agreement. This document is a starting point for higher education institutions that are looking to contract with their faculty to create OER. It was developed in a way that makes it easy for institutions to edit to meet their own campus intellectual property policy requirements.

Following a Rebus Community Office Hours on creating a template publishing agreement, several existing agreements were collected from institutions as a starting point, from which Creative Commons USA created an initial draft agreement. OTN members from the Colorado State University System, Temple University, University of Colorado at Boulder, University of Kansas and University of Massachusetts at Amherst solicited feedback from their copyright and general counsel offices on the draft, in relationship to their institution’s intellectual property policy. Creative Commons USA used that feedback to create this Adaptable OER Publishing Agreement.

The Adaptable OER Publishing Agreement is licensed with a CC BY license, allowing institutions to customize it to meet their local needs.
